4. Where Do We Collect Your Data From?
Your Account (On-Line or Instore)
When you register on our Site or in Store, we ask for your first and last name, email address and you will need to set a secure password to set up your account. We also allow you the option of providing additional information, including, but not limited to, your date of birth and gender. The more we know about you, the more we can personalise your site experience and tailor our specific products and promotions to meet your interests.
The information we collect through the "My Account" feature is used to help improve our Site, customize your site experience, deliver updates or notices about our organisation, allow you to review your order history, you can chose here to “opt in” to receive direct, digital, and/or email marketing communications about our products and promotions.
Purchases
When you make a purchase through our Site OR instore, we ask for information such as your name, email address, billing address, telephone number, payment card information, and shipping address. This information is used to process, confirm, and ship your order.
When shipping an order to a third party, you will need to provide their name, shipping address, telephone number, and email address. Such information is used solely to complete the order and to notify the recipient of their shipment. We will not use the personal information of a third-party recipient for marketing purposes.
Email / SMS Communications and your choices
If you want to get emails or text messages from Clarks about new products or special offers, you can choose to sign up when you create an account or make a purchase. In Canada, we rely on your express opt-in consent before sending you any marketing communications, as required under PIPEDA and applicable anti-spam legislation.
You can unsubscribe at any time:
- For emails: Click "unsubscribe" at the bottom of any message or use our Privacy Web Form
- For texts: Reply "STOP" to any message we send
If you use the OneTrust form to unsubscribe from all marketing and forget to include your phone number, no problem—we’ll still stop the emails. But to stop the texts, you’ll need to submit a new request with your number.
Even if you unsubscribe from marketing messages, we may still send you important emails about your account or orders.
Surveys and Contests
We may, on occasion, run surveys, sweepstakes, or other like contests. If you choose to participate, we may ask for your name, mailing address, email address, social media profile and/or telephone number. We use this information to administer the relevant survey or contest and for award notification purposes, as applicable.
Product Ratings, Feedback and Reviews
When making a purchase(s) you will be given a link post purchase or receive an email that allows you to provide ratings and reviews about our products. To submit a review, you need to provide some personal information. Direct Mail Communications and your Choices US ONLY

International Transfers and Safeguards (Canada specific)
Some of the service providers we use are located outside of Canada, including in the United States and Europe. 7. How Long Do We Keep Your Data?

Verification of Consumer Requests and Data Retention of The Requests
Clarks reserves the right to respond only to verifiable consumer requests. A verifiable consumer request is one made by:
- The consumer who is the subject of the request,

- A natural person who can demonstrate that they are lawfully authorized to act on behalf of the consumer.
10. Data Retention
Clarks will retain personal data for the time strictly necessary to provide users with the requested services or to fulfil legal or tax obligations for the minimum period prescribed by law.
In order to establish the retention period for personal data collected and stored through the Website with the User's consent, Clarks will consider multiple factors to ensure that personal data is not stored for a period longer than is strictly necessary for the purposes for which it was collected or for compliance with legal obligations. These criteria also include:
- the purpose for which the Website retains personal data;
- legal, tax, and regulatory obligations;
- the type of ongoing relationship with the Data Subject user or customer (how often the user accesses their personal account on the Website, whether the user maintains active consent to receive commercial communications, how often they browse and/or make purchases on the Website, etc.);
- any specific requests from the Data Subject regarding the erasure of personal data. Therefore, Clarks shall retain:
- personal data collected and processed in relation to the Data Subject's personal account for a maximum period of 2 years from the date of the last interaction between the Data Subject and the Website or other contact (email, customer service) with Clarks;
- The detailed data of each online purchase is stored for a period of up to 10 years from its last registration.
Clarks undertakes to implement procedures that ensure the timely and secure erasure or anonymization of your personal data from the moment it is no longer necessary or the grounds for its lawful retention cease to exist.
Data Retention of Privacy Rights Requests via One Trust
We retain records of privacy rights requests Via One Trust only for the time necessary to meet our legal obligations and demonstrate compliance with applicable data protection laws.
United States (General)
- We retain privacy rights requests for up to 24 months.
- Requests are deidentified, and any personally identifiable information (PII) is redacted.
- Attachments are excluded from retention and are not stored beyond the time required to process the request.
California
- In line with the California Consumer Privacy Act (CCPA/CPRA), we retain records for up to 24 months.
- After that period, we permanently delete the request, including any associated subtasks and attachments.
Canada
- Under the Personal Information Protection and Electronic Documents Act (PIPEDA), we retain privacy rights requests for three years.
- After this period, all requests, including subtasks and attachments, are permanently deleted.
All request data is stored securely and accessible only to authorized personnel involved in compliance and data protection functions.

12. Children Under 16
Clarks does not knowingly collect or solicit personal information from individuals under the age of 16. The only exception is when a parent, guardian, or responsible adult voluntarily provides such information for specific purposes, such as fitting services or customer support.
If we discover that we have collected personal information from a minor under the age of 16 without appropriate consent, we will delete that information as soon as reasonably possible.
Minimum age requirements may vary based on jurisdiction. For example, some countries or U.S. states may require consent at age 13 or 14. We apply the age of 16 as a uniform minimum to align with international standards.
